Short Sale
A short sale is a sale arranged by someone who can’t pay the mortgage. The sale funds go to the institution that makes the loan to pay off its debt, though it’s less than the amount owed. There is a possibility that the borrower may face a tax liability if the lender forgives the deficiency.
Deed in Lieu of Foreclosure
A deed in lieu of foreclosure prevents the actual foreclosure from occurring. The borrower essentially signs the deed of the property over to the lender, and vacates the property. The lender may reserve the option to go after you for any deficiency (the difference between the home's fair market value and your outstanding debt) that remains after the house is sold.
